Job Responsibilities
- Advise clients on intellectual property strategy, including patent, trademark, copyright, and trade secret protection across domestic and international markets.
- Draft, file, and prosecute patent and trademark applications, respond to office actions, and manage communications with IP offices and foreign associates.
- Prepare, review, and negotiate IP-related agreements, including licenses, technology transfer agreements, NDAs, joint development agreements, and SaaS or software licenses.
- Conduct IP due diligence for mergers and acquisitions, venture financings, and strategic collaborations, identifying risks, encumbrances, and opportunities to enhance IP value.
- Manage IP enforcement and defense matters, including cease-and-desist letters, administrative proceedings, litigation support, domain name disputes, and online brand protection.
- Collaborate with R&D, product, marketing, and business teams to identify protectable innovations and ensure IP compliance, including open-source and standard-essential patents.
- Monitor legal developments in IP law, including case law, regulatory changes, and international treaties, and provide internal training and policy guidance.
Minimum Requirements
- Juris Doctor (J.D.) or equivalent law degree from an accredited institution.
- Active license to practice law and good standing with at least one jurisdiction; registration to practice before the USPTO or relevant patent office may be required for patent-focused roles.
- 1–3 years of experience for junior or associate roles, or 5+ years for senior counsel and partner-track positions in intellectual property law.
- Demonstrated experience in at least one IP discipline, such as patent prosecution, trademark clearance and registration, copyright counseling, or IP litigation.
- Strong legal research, drafting, and analytical skills, with the ability to translate complex technical or creative concepts into clear legal positions.
- Excellent communication and client management skills, with the ability to advise engineers, founders, and business stakeholders on risk and strategy.
- For certain patent roles, a technical degree or background in engineering, computer science, life sciences, or a related STEM field may be required.
Preferred Skills
- Experience managing global IP portfolios and coordinating with foreign counsel on filings, oppositions, and enforcement actions in multiple jurisdictions.
- Familiarity with technology transactions, including software licensing, SaaS agreements, open-source compliance, data rights, and cloud services.
- Background in a specific industry vertical such as pharmaceuticals, biotechnology, medical devices, fintech, consumer products, or media and entertainment.
- Prior involvement in IP litigation, administrative proceedings (e.g., TTAB, PTAB), or alternative dispute resolution related to infringement and licensing disputes.
- Proficiency with IP docketing systems, portfolio management tools, and legal research platforms, along with a data-driven approach to portfolio strategy and risk assessment.
